Sec 5.2(1)(c) of the ID screening regs of Aeronautics Act: “An air carrier shall not transport a passenger if the passenger does not appear to be of the gender indicated on the identification he or she presents.”

This can’t be legal, can it?

Not to mention all the androgynous-looking people out there, whose gender presentation is either inherently or purposely neither overtly masculine or feminine. AAAAARGH. bleh.

I think people would be safe if they just updated their picture? I don’t think this is intentionally discriminatory. 

Well no, not intentionally, but that doesn’t change the fact that it’ll wind up having discriminatory effects on people. Say a trans woman gets her stuff in order, and gets the ID changed (far easier to do than to get it changed for, say, social security, but still tricky) to reflect the proper female marker. BUT she has only been through therapy to confirm trans status and get the recommendation to start hormones, and her first dose isn’t until next week. OR maybe she’s been on hormones for a while, but hasn’t started showing much outward change yet.

ALL OF A SUDDEN HER GRANDMOTHER PASSES AWAY. This hypothetical woman lives in…. oregon. Her grandmother lives in georgia. AND IS GOING TO LEAVE THIS TRANS WOMAN A LARGE INHERITANCE as long as she attends the funeral and preparations, etc. that would solve all her financial worries for the next six years, SO SHE ABSOLUTELY HAS TO GO.

and the TSA, saying that “He doesn’t look like a woman named Clarissa” denies her flight privileges. Even though it’s completely legit, and she’s at a seriously hard stage of life, and it’s the last thing she needs on top of just getting laid off from the office tech job that was paying her tuition because of company budget cuts.

Out there is a very real person with issues probably too similar to these for comfort. Even if you have an updated picture, you know, it’s still only on your shoulders up. Most body/gender identification will inevitably take place below the collar bone. The number of people who are legitimately flying for some innocent life purpose will FAR outweigh the number of ‘terrorists’ or whatever stopped by an absolutely astronomical amount. You know?

So that’s why it’s absolutely ridiculous and damaging, even though I agree, there was probably not even the slightest hint of intended offense or exclusion or harm, because the people in charge of these things don’t think in terms of real people. they think numbers and likelihood and statistic… and then decide to do things like this anyway, because it could cut back problems by .0007%, despite being absolutely not likely to really be necessary.


MASSIVE EDIT:  my mistake, we’re talking about canada. I don’t know why I forgot about this. erm. CHANGE ALL REFERENCES TO LOCATION/NAMED FLIGHT AUTHORITY TO A CANADIAN EQUIVALENT, I GUESS.  sorry about that.  >____>;;;  the main point is the same, though, if you don’t pass as your correct gender for whatever reason you’re screwed out of a rightful trip….

So I totally agree, it’s completely unnecessary, the only thing you should have to do is look reasonably like yourself in your picture. I do however, think it’s a bit harsh to call it anti-trans legislation. In caps? A bit alarmist on the OP’s part.

I guess not everything is better in Canada?
